Shumlin Confirms New Vermont Estate Tax Guidelines for Same-Sex Marriages

Montpelier, Vt., July 25, 2013—Governor Shumlin confirmed on July 24, 2013, that the Vermont Department of Taxes will work with any Vermonter who is entitled to a refund for overpayment of Vermont estate taxes as a result of the recent U.S. Supreme Court decision striking down a portion of the federal Defense of Marriage Act. The Supreme Court opinion ensures equality for gay couples married under state law. Vermont has allowed gay couples to marry since 2009. Vermont's estate tax is tied in part to the federal estate tax. Any surviving spouse of a gay marriage who did not receive a marital benefit at the federal level in an estate in which Vermont state tax was paid may be entitled to a refund. Such taxpayers are urged to contact the Tax Department to determine if they are eligible for a refund by calling (802) 828-3763.
